Preamble

These General Terms and Conditions of Sale (the "Terms") apply without restriction or reservation to all sales concluded by the sole proprietorship Breya, whose details are as follows:

Breya sells footwear and leather goods (mules, sandals, slippers and boots) on its website.

The Customer declares that they have read and unreservedly accepted these General Terms and Conditions of Sale prior to placing their order. Validating an order implies full and unreserved acceptance of the Terms.

Article 1: Products

The Products offered for sale on the Site are intended for the Customer's personal and private use.

Each Product is accompanied by a detailed description on the Site, providing the Customer with essential information about its characteristics and price.

Photographs and images of the Products are provided for illustrative purposes only and are not contractually binding.

All Products comply with the French legal provisions in force on the date they are put on sale, in particular those relating to safety, personal health, fair commercial practices and consumer protection.

Article 2: Prices

The applicable sale prices are those in force at the time the order is placed, as displayed on the Site. All prices are shown in Euros and are inclusive of all taxes.

The total amount payable by the Customer is clearly indicated before the order is confirmed.

The Seller reserves the right to modify its prices at any time. However, the price charged to the Customer will always be the one in force at the time their order is validated.

Article 3: Product Availability

The Products presented on the Site are offered for sale while stocks last.

If a Product is unavailable, the words "Out of stock" or "Coming soon" will appear in its description. Payment for the item is taken when the basket is validated, including for an item that is temporarily unavailable but can be reserved, in the same way as for a standard order.

Article 4: Legal Guarantees

All Products benefit from the legal guarantees in force, in accordance with the provisions of the French Civil Code and the French Consumer Code:

  • Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code):
    The Customer has a period of two (2) years from delivery of the Product in which to act.
    The Customer may choose between repair or replacement of the non-conforming Product, subject to the cost conditions provided for by law.
    The Customer is not required to provide proof of the Product's lack of conformity during the legal presumption period following delivery of the Product.
  • Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code):
    The Customer may invoke the guarantee in respect of hidden defects in the item sold.
    Where this guarantee is invoked, the Customer may choose between rescission of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

Article 5: Orders

Every Product order carries an obligation of immediate payment.

At the end of the ordering process, the Customer receives an email confirming that their order has been registered.

The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute relating to a previous order remains outstanding.

The Seller will inform the Customer by email when their order has been dispatched.

Article 6: Payment

The total amount payable by the Customer is due in full at the time the Product is ordered.

The following payment methods are accepted:

  • Payment by bank card (credit/debit)
  • Payment via PayPal
  • Payment via Apple Pay
  • Payment in instalments via our instalment payment partner

Instalment or deferred payment is offered subject to acceptance by our payment partner, and is governed by that partner's own terms and conditions, which the Customer accepts at the time of payment. Any refusal to grant instalment or deferred payment may render the purchase contract void, unless the Customer agrees to pay the purchase amount in full. If the instalment or deferred payment solution is cancelled, these Terms will be terminated as of right, unless the Customer pays the purchase amount in full.

The Seller reserves the right to suspend or cancel any order in the event of difficulties in collecting payment.

Article 7: Delivery

Products are delivered by post after the order has been placed and paid for in full by the Customer.

Delivery is made to the postal address provided by the Customer when placing their order. If inaccurate or incomplete information makes delivery impossible, the Seller will notify the Customer by email. Without a reply from the Customer, the order may be cancelled and the sums paid refunded.

  • Dispatch and delivery times: Orders are dispatched within 24 to 48 hours and delivered within 5 to 8 business days from the order date.
  • Delivery costs: Home delivery is free on all orders, with no minimum purchase, in every country served.
  • Customs duties and import taxes: For orders delivered outside the European Union, customs duties, import taxes and handling fees are included in the displayed price and covered by the Seller. The Customer has nothing to pay on delivery.
  • Delivery delays: In accordance with Article L216-6 of the French Consumer Code, if the Product is not delivered within the stated timeframe, the Customer may give the Seller formal notice to deliver within a reasonable additional period and, failing that, cancel the contract and obtain a refund of the sums paid.

Article 8: Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) days from receipt of the purchased Product.

To exercise their right of withdrawal, the Customer must notify the Seller of their decision, providing their name, postal address, telephone number and email address, by post or by email to contact@breyashop.com.

In the event of withdrawal, the Customer must return the Product to the Seller. The Product must be returned in its original packaging, with tags attached, in perfect condition, unworn, free from marks or damage.

The direct cost of returning the Product is borne by the Customer.

The Seller will refund all payments received without undue delay and no later than fourteen (14) days from receipt of the returned product in perfect condition. The Seller will use the same means of payment as that used by the Customer for their order.

Article 9: After-Sales Service, Complaints & Disputes

For any question or complaint regarding the sale and delivery of a Product, the after-sales service is available to the Customer by email at: contact@breyashop.com.

In accordance with legal provisions, the Customer may resort to conventional mediation, in particular before the Consumer Mediation Commission, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute. The mediator's contact details are available on our site.

In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution (ODR) platform, facilitating the independent out-of-court settlement of online disputes between consumers and traders in the European Union. Article 10: Liability

The Seller shall not be held liable for non-performance or improper performance of the sale resulting from:

  • An act of the Customer;
  • The insurmountable and unforeseeable act of a third party to the contract;
  • An event of force majeure.

The Seller cannot be held liable for malfunctions or damage related to the use of the Internet, such as service interruption, external intrusion, computer viruses, fraudulent use of a bank card, and so on.

Article 11: Intellectual Property

The Products offered for sale on the Site, as well as all elements comprising it (texts, images, designs, trademarks, logos, etc.), are protected by design law and trademark law.

Any reproduction, in whole or in part, distribution or use for commercial purposes of the Products or elements of the Site is strictly prohibited without the Seller's prior written authorisation.

Article 12: Personal Data

The Seller undertakes not to disclose to third parties the personal data provided by the Customer, unless required to do so by law or by court order.

In accordance with the applicable regulations on personal data protection, the Customer has the right to access, rectify, modify, object to and delete information concerning them.

Article 13: Applicable Law

These General Terms and Conditions of Sale and the contractual relationship between the Seller and the Customer are governed by French law. Any dispute not resolved amicably will be submitted to the competent French courts.
