General Terms and Conditions of Sale (GTC)

Preamble

These General Terms and Conditions of Sale (GTC) apply without restriction or reservation to all sales concluded by the sole proprietorship Breya, whose information is as follows:

Breya markets products in the Footwear & Leather Goods (mules) category on its website.

The Customer declares having read and unreservedly accepted these General Terms and Conditions of Sale prior to placing their order. Placing an order implies full and complete acceptance of the GTC.

Article 1: Products

The Products offered for sale on the Website are intended for personal and private use by the Customer.

Each Product is accompanied by a detailed description on the Website, providing the Customer with essential information about its characteristics and price.

The photographs and visuals of the Products are for illustrative purposes only and are not contractually binding.

All Products comply with the French legal provisions in force on the date they are put on sale, particularly those relating to safety, human health, fair commercial transactions, and consumer protection.

Article 2: Price

The applicable selling prices are those in force at the time the order is placed, as displayed on the Website. All prices are indicated in Euros and are inclusive of all taxes (TTC).

Delivery costs, if any, are added to the prices of the ordered Products. The total amount due by the Customer is clearly indicated before order confirmation.

The Seller reserves the right to modify its prices at any time. However, the price invoiced to the Customer will always be the one in force at the time of validation of their order.

Article 3: Product Availability

The Products presented on the Website are offered for sale within the limits of available stock.

In case of unavailability of a Product, the mention "Out of Stock" or "Coming Soon" will appear on its description. Payment for the item will be made when the cart is validated, even for a temporarily unavailable but reservable item, similar to a standard order.

Article 4: Legal Guarantees

All Products benefit from the legal guarantees in force, in accordance with the provisions of the Civil Code and the Consumer Code:

  • Legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code):
    The Customer has a period of two (2) years from the delivery of the Product to act.
    The Customer can choose between repair or replacement of the non-conforming Product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code.
    The Customer is exempt from providing proof of the Product's lack of conformity for a period of six (6) months following the delivery of the Product.
  • Guarantee against hidden defects (Articles 1641 et seq. of the Civil Code):
    The Customer may invoke the guarantee due to hidden defects in the sold item.
    In the event of invocation of this guarantee, the Customer has the choice between rescission of the sale or a reduction in the selling price, in accordance with Article 1644 of the Civil Code.

Article 5: Order

Any Product order entails an immediate payment obligation.

At the end of the order process, the Customer receives an email confirming the registration of their order.

The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute relating to a previous order still exists.

The Seller will inform the Customer by email of the shipment of their order.

Article 6: Payment

The total amount due by the Customer is payable in full at the time of ordering the Product.

The following payment methods are accepted:

  • Payment by bank card (credit/debit)
  • Payment via PayPal
  • Payment via Apple Pay

Alma's credit service is offered for the payment of purchases and the execution of payment, provided that the person purchasing the goods or service through Alma ("Buyer") accepts the installment payment or deferred payment agreement.

  • Fees may be charged by Alma.
  • Any refusal by Alma to grant installment payment or deferred payment may result in the lapse of the purchase contract for the goods or service ("GTC"), unless the Buyer agrees to pay the purchase amount in full.
  • In case of termination of the GTC, the installment payment or deferred payment agreement will be terminated automatically.
  • In case of withdrawal from the installment payment or deferred payment solution used for your payment, the GTC will be terminated automatically, unless you pay the amount of your purchase in full through Alma. If the product has already been shipped to you, you must return it within the maximum period specified in these GTC.

The Seller reserves the right to suspend or cancel any order in case of difficulties encountered during payment collection.

Article 7: Delivery

Delivery of Products is carried out by postal shipment after the order has been placed and full payment has been made by the Customer.

Delivery is made to the geographical address provided by the Customer when placing their order. In case of inaccurate or incomplete information making delivery impossible, the Seller will notify the Customer by email. Without a response from the Customer, the order may be canceled and the amounts paid refunded.

  • Shipping and Delivery Times: We guarantee shipping and delivery within a total of 3 to 5 working days from your order for delivery in France.
  • Home Delivery Fees: Home delivery is free for any order with an amount equal to or greater than €75. For orders under €75, a flat fee of €4.95 will be applied.
  • Delivery Delay: A delivery delay of more than seven (7) days, not due to a case of force majeure, may result in the termination of the sale if the Customer requests it by registered letter with acknowledgment of receipt addressed to the Seller's registered office.

Article 8: Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Customer has a right of withdrawal of fourteen (14) days from the receipt of the purchased Product.

To exercise their right of withdrawal, the Customer must notify their decision to the Seller by providing their name, geographical address, telephone number, and email address, by post or by email to contact@breyashop.com.

In case of withdrawal, the Customer must return the Product to the Seller. The Product must be returned in its original packaging, with labels, in perfect condition, unworn, without stains or damage.

The costs of returning the Product are borne by the Seller via a prepaid return label.

The Seller will refund all payments received (including, where applicable, initial delivery costs for a full return of the order) without undue delay and at the latest fourteen (14) days from receipt of the returned product in perfect condition. The Seller will use the same means of refund as that used by the Customer for payment of their order.

Article 9: After-Sales Service, Claims & Disputes

For any questions or complaints regarding the sale and delivery of a Product, after-sales service is available to the Customer by email at: contact@breyashop.com.

In accordance with legal provisions, the Customer has the option of resorting to conventional mediation, particularly with the Consumer Mediation Commission, or to any alternative dispute resolution method (conciliation, for example) in case of dispute. The mediator's contact details are available on our website.

In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an Online Dispute Resolution (ODR) platform, facilitating independent out-of-court resolution of online disputes between consumers and professionals in the European Union. Article 10: Liability

The Seller's liability cannot be engaged in case of non-performance or improper performance of the sale resulting from:

  • Either the Customer's fault;
  • Or the insurmountable and unforeseeable act of a third party to the contract;
  • Or a case of force majeure.

The Seller's liability cannot be engaged in case of malfunctions or damages related to the use of the Internet network, such as service interruption, external intrusion, presence of computer viruses, fraudulent use of the bank card, etc.

Article 11: Intellectual Property

The Products offered for sale on the Website, as well as all elements comprising it (texts, images, designs, brands, logos, etc.), are protected by design and model law and trademark law.

Any reproduction, total or partial, distribution or use for commercial purposes of the Products or elements of the Website is strictly prohibited without the prior written authorization of the Seller.

Article 12: Personal Data

The Seller undertakes not to communicate to third parties the personal data provided by the Customer, unless required by legal provisions or by court decision.

In accordance with the regulations in force relating to the protection of personal data, the Customer has a right of access, rectification, modification, opposition and deletion of information concerning them.

Article 13: Applicable Law

These General Terms and Conditions of Sale and the contractual relations between the Seller and the Customer are governed by French law. Any dispute not resolved amicably will be submitted to the competent French courts.
